FEMA Implementation of Allocation Order on Exports of Scarce PPE and Notice on Exemptions

FEMA published a Temporary Final Rule and subsequent notice in the Federal Register on April 10 and April 17, 2020, outlining implementation of the President’s Memorandum, “Allocating Certain Scarce or Threatened Health and Medical Resource to Domestic Use.”

The Temporary Final Rule is an allocation order issued by the FEMA Administrator to review exports of five types of Personal Protective Equipment (PPE), also referred to as “covered materials,” needed to respond to the coronavirus (COVID-19) pandemic.  The second notice provides guidance on the implementation of the allocation order and includes several types of shipments that will generally be exempted from hold by U.S. Customs and Border Protection (CBP).
